Estate and Trust Mediation

The attorneys of Davis, Frawley, Anderson, McCauley, Ayer, Fisher & Smith assist clients in
mediation of issues related to litigation and potential litigation involving estates, trusts,
probate and fiduciary responsibilities.

All contested matters before the Probate Court in South Carolina can be ordered by the Judge to
undergo the Alternative Dispute Resolution process of Mediation or the parties can voluntarily
submit their dispute to Mediation.  Many Probate Court disputes are successfully settled through
Mediation because that process allows families and interested individuals to creatively deal with
assets and interests to design a resolution that avoids the cost of litigation and meets at least
some needs of each participating party rather than the absolutes of litigation, where one party
generally wins and one looses.

Because the Probate Code allows Family Agreements or Agreements Among Heirs to settle issues
before the Court in almost any manner so long as everyone is in agreement, the option to work out
an agreement is often more favorable that submitting a matter to a Judge for decision where
parties will win and loose, and where further divisions could occur among related parties.
