Civil litigation the court process in which a legal dispute between two or more parties involving, among various things, money damages, injunctive or equitable relief, or specific performance such as the enforcement of a contract or agreement in dispute, evolves into a law suit between the parties. Civil litigation can involve matters relating to real estate, such as, among other things, actions to try title, partition actions, nuisance, trespass, easements, encroachments, condemnations, damage to real estate, surface water or drainage issues. It can also involve matters relating to personal property, such as claim and delivery actions, actions to recover personal property wrongfully taken or withheld, and damage to personal property. Breach of contract claims are civil litigation, as are personal injury claims, which can involve automobile accidents, slip and fall claims, premises liability, dog bites or animal attacks, products liability claims, and matters involving negligent acts or omissions which result in damage to others.
Civil litigation encompasses both Plaintiff actions, in bringing the lawsuit to seek appropriate and fair compensation for loss, and Defense of those claims, in warding off spurious actions not supported by the evidence. Civil Litigation can involve cases that are tried before a judge and jury, or a judge alone.
Civil litigation encompasses a broad range of disputes. Several common types of civil litigation might include:
• Environmental Law
• Landlord/Tenant
• Products Liability
• Personal injury
• Intellectual Property
• Construction
• Medical Malpractice
• Employment & Labor
• Real Estate
• Anti-Trust
• Worker’s Compensation
• Education Law
