Can I recover my attorney fees from the person who sued me if I win?

Generally, no. In South Carolina, unless there is a statute or an agreement providing for the recovery of attorney fees by the prevailing party in a lawsuit, each party is responsible for his own attorney fees. There are some statutory provisions for recovery in the event of frivolous lawsuits, but those require proof of more than simply prevailing in a lawsuit.
